He had been previous 1 CONC ly examined, and the further enquiry was to go more minutely into the affa 1 CONC ir. The Jarvises, it will be recollected, were some of the parties mix 1 CONC ed up with Reay in his wine transactions. 1 CONT A long examination of Beckingham was entered into, Mr Wilkins appearing f 1 CONC or the assignees, and Mr Bagley for Beckingham. 1 CONT The substance of the evidence was, that in the course of 10 months deali 1 CONC ng with the elder Jarvis, the leading partner in the firm, Beckingham h 1 CONC ad purchased between £5000 and £6000 worth of wine, which he describ 1 CONC ed as being of "very little value". It was purchased in bond or otherwis 1 CONC e, and he paid for it £700 in cash, and the remainder in cigars. The quan 1 CONC tity of cigars he had in this sort of dealing sold to the bankrupt amount 1 CONC ed to "many thousand pounds weight". He had settled his accounts in Janua 1 CONC ry last, by a proper balance with the bankrupts. He said he sold the ciga 1 CONC rs, (East India) to Jarvis at the rate of 18s per lb., without duty. Th 1 CONC ey might probably have realized as much as half that amount. He kept no p 1 CONC articular account of these cigars, so he could not tell precisely whe 1 CONC re he bought them. He believed he received them from Mr Strong of Watli 1 CONC ng Street. His own explanation of his not keeping no account of them wa 1 CONC s, that he did not consider it necessary, "he bought them in barter, a 1 CONC nd he sold them in barter". After giving further particulars of his opera 1 CONC tions with Jarvis, and some details of his sales of the wines, which, acco 1 CONC rding to his account, did not fetch anything like the price he paid for th 1 CONC em. 1 CONT The Commissioners expressed themselves satisfied with the answers the witn 1 CONC ess gave, and the proceedings were therefore concluded. 1 CONT If he had refused to give answers, it was probable that he would have be 1 CONC en committed by virtue of the power of the Subdivision Court in such cases 1 CONC . 1 CONT 1 CONT ================================================= 1 CONT 1 CONT From The Times - 4 Jun 1847 - pp 7 1 CONT Bail Court June 3 - sitting "in banco" before Mr Justice Wightman 1 CONT Beckingham v Powell 1 CONT 1 CONT Mr Serjeant Shee and Mr Cole were counsel for the plaintiff; and Mr Humfr 1 CONC ey and Mr Lush for the defendant. 1 CONT This was an action brought against the defendant as the acceptor of a bi 1 CONC ll of exchange for £250, drawn by one Walter Dowling or Downing, and by h 1 CONC im endorsed to the plaintiff. The defendant pleaded that there was no con 1 CONC sideration given to him for the bill; that on the 10 October 1846 the defe 1 CONC ndant delivered the bill to Downing for the purpose of getting it discount 1 CONC ed, but that Downing did not get it discounted, but parted with it and end 1 CONC orsed it to the plaintiff without consideration, and in violation of go 1 CONC od faith; and that he endorsed it to the plaintiff to enable him (Downin 1 CONC g) to get the money from the defendant; and that the bill was endorsed aft 1 CONC er it became due. 1 CONT Mr Humfrey, for the defendant, stated that the defendant was a young ma 1 CONC n, and had unfortunately become acquainted with persons connected with t 1 CONC he turf; that he met Downing at the Old King's Arms, Holborn Hill; and th 1 CONC at he there accepted two bill for £250 each, which were drawn by Downin 1 CONC g; that they were so accepted, and were delivered by the defendant to Down 1 CONC ing in order that he might get them cashed, but he could not get the mon 1 CONC ey from him. He then caused Downing to be taken up on a charge of steali 1 CONC ng the bills. When before the Magistrate, Downing stated that the bills h 1 CONC ad been destroyed. The Magistrate of course held that this was not a felo 1 CONC ny and Downing was discharged; but upon the first bill becoming due it w 1 CONC as presented at the defendant's father's house, when the father having pre 1 CONC viously been so instructed by his attorney looked particularly at the bi 1 CONC ll and saw that it had not been endorsed. Of course the defendant did n 1 CONC ot pay the bill, and the present action was brought; if he now proved eith 1 CONC er of the defendant's pleas he should be entitled to a verdict. The follow 1 CONC ing evidence was then adduced for the defendant. 1 CONT Richard Powell - I am the father of the defendant who was 21 in Septemb 1 CONC er last. I reside in St John's Wood. On the 13 November a person present 1 CONC ed this bill of exchange. I examined it, and at that time there was no end 1 CONC orsement upon it. I had been instructed by my attorney particularly to lo 1 CONC ok at it. It now appears to be endorsed by Walter Downing. 1 CONT Cross examined - I knew nothing before of my son being a sporting ma 1 CONC n. My son had previously told me about the bill. He told me he never g 1 CONC ot a farthing for it. 1 CONT Re examined - My son told me he had been induced to accept two bills for £ 1 CONC 250 each, and that he had not received a farthing for them. He said th 1 CONC at he had done it at Butler's in Holborn Hill, and that Butler drew one bi 1 CONC ll and Downing the other. 1 CONT William Butler - I keep the Old King's Arms, Holborn Hill. I know Downin 1 CONC g. I have seen him on the turf. In October Downing and the defendant we 1 CONC re at my house. There was a bill which was destroyed, and then I wrote t 1 CONC he bodies of two bills, which were signed by Downing as the drawer, and Po 1 CONC well put his name as acceptor. They were for £250 each; one at one mont 1 CONC h, the other at two months date. They talked of sporting matters. I hea 1 CONC rd Powell say if you can let me have £50 that will do as I can go on Sund 1 CONC ay night. To that time Downing had often been a visitor at my house. I kn 1 CONC ow that he was afterwards taken up. I have not seen Downing upon the subje 1 CONC ct of the bill since. 1 CONT Cross examined - I understood Powell to be going to Newmarket. I don't kn 1 CONC ow where downing lives. 1 CONT Wilkinson - I am a policeman. Downing was charged with stealing the bil 1 CONC ls of exchange on 29 October. He was taken before the magistrate and disch 1 CONC arged. 1 CONT Frederick Harvey, clerk to the defendant's attorney - I attended before t 1 CONC he magistrates when Downing was in charge. Mr Roberts, Downing's attorne 1 CONC y, said, Powell need be under no apprehension about the bills, for them wh 1 CONC at he had heard he believed they were destroyed. 1 CONT Thomas Bearwash - I served Downing last Thursday with a subpoena to appe 1 CONC ar here today. 1 CONT Mr Serjeant Shee then addressed the jury for the plaintiff, and said, th 1 CONC at as regarded Downing subpoenaed for the defendant, he believed that inst 1 CONC ead of its being a subpoena to appear before the Queen herself at Westmins 1 CONC ter, it was to appear before the Queen herself at Ascot; or in other wor 1 CONC ds the subpoena was only to induce Downing to get out of the way, and n 1 CONC ot prove the consideration. He should submit that the only question was wh 1 CONC ether there was fraud when it came into the plaintiff's possession, and th 1 CONC at not having been proved he should submit after he had proved that the bi 1 CONC ll was endorsed before it was due, that the plaintiff was entitled to the 1 CONC ir verdict. 1 CONT James Wright - I am the plaintiff's attorney, and have been so for 10 year 1 CONC s. HE IS A WINE MERCHANT AND IMPORTER OF CIGARS, AND LIVES IN YORK ROAD, L 1 CONC AMBETH. He gave me this bill to present 10 days or a fortnight before it b 1 CONC ecame due. At the time that I received it I made a memorandum in my diar 1 CONC y. I have no doubt that the endorsement of Downing was upon it at the ti 1 CONC me I received it, because it has never been out of my hands since, and the 1 CONC re is the endorsement on it now. 1 CONT Cross examined - The plaintiff has a private house, and a "dry arch" und 1 CONC er Waterloo Bridge, where he keeps his wine and cigars. I have not the oth 1 CONC er bill, nor have I ever seen it. I believe the plaintiff has it. The plai 1 CONC ntiff told me he had. He does not keep the bills under the dry arch. The o 1 CONC ther bill was not presented to my knowledge. Perhaps he has thought one ac 1 CONC tion enough at a time. Downing has not been subpoenaed at all. (The witne 1 CONC ss handed in a subpoena upon which Downing was called). I am sure the endo 1 CONC rsement was on the bill at the time I first had it. 1 CONT Thomas Watkins - I am clerk to the last witness. I presented the bill. T 1 CONC he endorsement was on it then. I am quite sure of it. He became a partn 1 CONC er in the firm in 1871. 1 CONT In 1894 Mr Beckingham started in business as a coal exporter, and was entr 1 CONC usted by the late Sir Charles Mark Palmer with the sale abroad of the coa 1 CONC ls of John Bowes and Partners. The firm also became ship-owners. 1 CONT Later Mr Beckingham became managing director of the Broomhill Collierie 1 CONC s. He retired from the chairmanship in 1917, being succeeded by his so 1 CONC n, Mr E L Beckingham, but he remained on the Board. 1 CONT Mr Beckingham was associated with the first Lord Furness on the Board of D 1 CONC irectors of the "North Mail". 1 CONT In politics he was a Liberal, and had gifts of oratory which established h 1 CONC im as one of the best platform speakers of his day.
